Abstract
Reconditioned cellphones are damaged cellphones whose original components have been replaced with other components by modifying them, and being recycled for resale at a lower price. The purpose of this research is to find out the protection of consumers who buy refurbished cellphones without clear information from business players (study on Batam forum selling). The research method used is the empirical normative research method, namely research on norms or rules and the implementation of legal rules in real behavior as a result of the enforceability of these legal norms can be applied in people's behavior. Based on the problems that the authors examine, the results of this study are that the circulation of reconditioned cellphones occurs because consumers who buy do not know if the goods purchased are reconditioned goods. Then it was made worse by the actions of business actors who did not provide clear information and explanations regarding the condition of the goods to be sold to consumers. The form of consumer protection regulated in Law Number 8 of 1999 concerning Consumer Protection to obtain and protect consumer rights there are two types of protection, namely preventive protection or prevention by providing legal rules that guarantee consumer protection through supervision from both the ministry of trade and consumer protection agencies, and repressive protection or by resolving disputes that occur, repressive protection is divided into two ways, namely through the court (litigation) and outside the court (non-litigation). On this problem, the implementation of protection can be carried out by settlement out of court (non-litigation), namely by mediation which brings together the two parties involved, namely from the consumer side and the business actor, assisted by the BPSK assembly.
